The main principles of Dutch contract law

The principles of fairness and reasonableness are the dominant principles in Dutch contract law. According to the Dutch Civil Code, parties to an obligation must behave in a reasonable and fair manner. This article also states that any rule made binding on a party by virtue or usage of law, usage, or a legal act is not applicable if it would be unacceptable under the standard of reasonableness and fairness given the circumstances. These principles have many functions. The first is that all contracts should be interpreted according to these principles. The second function of the principles of fairness and reasonableness is to supplement the existing rights and obligations between the parties. The third function of Dutch contract law's principles of fairness and reasonableness is derogating, or restrictive.

To become a lawyer in the Netherlands, you are required to complete a law school at a Dutch university and then follow the three year Professional Education Program for the Legal Profession. A test will be taken to verify your basic knowledge. You'll also need to work as a trainee legal assistant under the guidance of an experienced Dutch attorney. In all cases, the Supervisory Council has to approve the supervisorship. Alternativly, you may become a trainee-entrepreneur.
